Death Penalty

The death penalty is a form of punishment that is only legal in 38 of the 50 states. Texas is currently one of the states offering the death penalty, but they do have restrictions to who can be convicted with the death penalty. The person also must be 17 years or older to be sentenced to the death penalty. Only those who have committed a capital crime can be sentenced to the death penalty. A capital felony is one that is murder in the very highest degree. This includes murder of a police officer, multiple murders, murdering of a child under 6, or murder during a prison escape. Although this is just a small list of what can actually be classified as a capital felony, there are many other crimes that can be classified in this area. Usually these crimes are looked at on a case by case basis because some of theme may be more or less heinous than the others. Once you have gotten the sentence from a judge, there are a certain number of appeals that you can go through before the sentencing will be carried out. Appeals normally go through the Court of Appeals, Texas Supreme Court, US Circuit Court of Appeals, and finally reaches the US Supreme Court. After your appeal has been through the US Supreme Court, you no longer have any appeals and your case will be closed. The only option after this is to get clemency by a governor of Texas.
