Automatic License Suspension
If you are pulled over for a DWI or DUI, there are a few things that are going to happen during the course of your time that you are pulled over. The first thing that the office will do when he first pulls you over will be to ask you for your driver’s license and your registration. Once the officer has seen these two documents from you, the officer will then most likely ask you to step out of the vehicle for some type of sobriety tests.
Sobriety tests can range for standing on one foot to blowing air into a breathalyzer machine to test your BAC level. If you refuse to do any of the sobriety tests that the officer asks you to do, there are consequences to the rules, but he will allow you to do that. Once you have refused to take the breathalyzer test is when the Automatic License Suspension will kick in.
An Automatic License Suspension is when the state will automatically take away your license based on lack of evidence allowing them to make a decision on your sobriety that evening. The suspensions will most of the time last for a certain period of time well after your trial has been taken care of. Usually license suspensions can last anywhere from 5 days to 180 days depending on the severity of the case and what your prior criminal background is. When you go to your trial date, the judge will tell you exactly how long the suspension is supposed to be in place for.
