The Arrest Process
When you are being arrested, there is a certain process that must be followed. There are also things that you should do, and things that you should not do when you are being arrested. It is important to keep these things in mind if you are arrested.
On the authorities' side, there are certain procedures that they must go through in order to arrest you. First, they must obtain a warrant for your arrest or have probable cause for the arrest. When they do arrest you, they must explain your Miranda Rights to you. These rights do not have to be presented in any particular way, but they must be explained to you.
Your Miranda Rights include the right to remain silent, and the right to an attorney. This means that you do not have to say anything to the police that might incriminate you. You should adhere to this right until you have your attorney present. While you may want to protest your arrest and argue your innocence, it is best to stay silent.
When you are being arrested, you should comply with the police or arresting authority. This will make things much easier later in the process. If you do anything noncompliant during the arrest process, it may lead to difficulties in your trial or getting you out of jail.
