When you are arrested, you are put in jail. Generally, you are granted bail. This is an amount of money that you pay in order to be released from jail. Bail is usually fairly expensive because it is used to ensure that you will return for your court date. Once you have gone through the criminal process, the bail posted is returned to whoever posted it.

Because bail can be so expensive, not everyone can afford to pay it. For this reason, bail bondsmen, also called bond agents, exist. Bail bondsmen post your bail for you for a fee. This can change from agent to agent, but generally to process is fairly similar. In order to post your bail, the bondsman will need some sort of collateral. On top of this, bondsmen will generally take a percentage of the owed bail.

This percentage is usually 10%. This is a non refundable fee because it is the compensation for services rendered by the bondsman. This means that if bail was set at $10,000, the bondsman will be owed $1,000 for posting bail. Some jurisdictions, however, have started a practice of accepting 10% of bail as a cash payment. If the case is resolved without any violations of the conditions of bail, the 10% cash deposit is generally returned just like a normal bail payment would be.
